BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 33, Penal Code, is amended by adding Section 33.07 to read as follows:
Sec. 33.07. ONLINE HARASSMENT. (a) A person commits an offense if the person uses the name or persona of another person to create a web page on or to post one or more messages on a commercial social networking site : (1) without obtaining the other person’s consent; and (2) with the intent to harm, defraud, intimidate, or threaten any person. (b) A person commits an offense if the person sends an electronic mail, instant message, text message, or similar communication that references a name, domain address, phone number, or other item of identifying information belonging to any person: (1) without obtaining the other person’s consent; (2) with the intent to cause a recipient of the communication to reasonably believe that the other person authorized or transmitted the communication; and (3) with the intent to harm or defraud any person. (c) An offense under Subsection (a) is a felony of the third degree. An offense under Subsection (b) is a Class A misdemeanor, except that the offense is a felony of the third degree if the actor commits the offense with the intent to solicit a response by emergency personnel. (d) If conduct that constitutes an offense under this section also constitutes an offense under any other law, the actor may be prosecuted under this section, the other law, or both. (e) It is a defense to prosecution under this section that the actor is any of the following entities or that the actor’s conduct consisted solely of action taken as an employee of any of the following entities: (1) a commercial social networking site ; (2) an Internet service provider; (3) an interactive computer service, as defined by 47 U.S.C. Section 230; (4) a telecommunications provider, as defined by Section 51.002, Utilities Code; or (5) a video service provider or cable service provider, as defined by Section 66.002, Utilities Code. (f) In this section: (1) ” Commercial social networking site ” means any business, organization, or other similar entity operating a website that permits persons to become registered users for the purpose of establishing personal relationships with other users through direct or real-time communication with other users or the creation of web pages or profiles available to the public or to other users. The term does not include an electronic mail program or a message board program. (2) “Identifying information” has the meaning assigned by Section 32.51.

Here is how stupid things can get on a public board – and now you know why I do not put up a public board. These are facts on file with the State of Texas and the Commission.
A woman, named Mrs. Pickard, was a target of an investigation being handled by our firm. She was interviewed at her residence with me and another investigator from our office. The entire conversation was recorded from the time the door opened until we left the front yard.
The State of Texas received a complaint regarding the interview two years after the interview. In that complaint it was stated that myself and the other investigator portrayed ourselves as “FBI Agents”. In such, the complainant just “wanted to report it” but refused to sign a sworn complaint. In accordance with state statute – the name of the complainant is withheld.
It was investigated and the tape was turned over to investigators. After reviewing the tape of the meeting – it was determined that the complainant was lying in their complaint. Since they did now swear out the complaint – they could not be prosecuted for filing a false police report.
It was at this time this story, rehashed now 20 times over, has been repeated without our comment. However, when the story is falsely posted on this board – or any – we will retort setting the record straight.
As for these other posts regarding a “Kelly Picard” – in Ms. Pickard’s defense the criminal record posted on this web site has nothing to do with her and we having nothing to do with posting it.
Again – many of you now understand why we do not have a post site and we killed the one we did have. Simply put, there are spineless people that attempt to hurt others that will say or post anything to try and hurt a business or a person based upon political beliefs. It must be said, that like the breaking of a great dam, the American decent into Marxism is happening with breath taking speed, against the back drop of a passive, hapless sheeple, excuse me dear reader, I meant people.
True, the situation has been well prepared on and off for the past century, especially the past twenty years. The initial testing grounds was conducted upon our Holy Russia and a bloody test it was. First, the population was dumbed down through a politicized and substandard education system based on pop culture, rather then the classics. Americans know more about their favorite TV dramas then the drama in DC that directly affects their lives. They care more for their "right" to choke down a McDonalds burger or a BurgerKing burger than for their constitutional rights. Then they turn around and lecture us about our rights and about our "democracy". Pride blind the foolish.
Then their faith in God was destroyed, until their churches, all tens of thousands of different "branches and denominations" were for the most part little more then Sunday circuses and their televangelists and top protestant mega preachers were more then happy to sell out their souls and flocks to be on the "winning" side of one pseudo Marxist politician or another. Their flocks may complain, but when explained that they would be on the "winning" side, their flocks were ever so quick to reject Christ in hopes for earthly power. Even our Holy Orthodox churches are scandalously liberalized in America.
The final collapse has come with the election of Barack Obama. His speed in the past three months has been truly impressive. His spending and money printing has been a record setting, not just in America's short history but in the world. If this keeps up for more then another year, and there is no sign that it will not, America at best will resemble the Wiemar Republic and at worst Zimbabwe.
These past two weeks have been the most breath taking of all. First came the announcement of a planned redesign of the American Byzantine tax system, by the very thieves who used it to bankroll their thefts, loses and swindles of hundreds of billions of dollars. These make our Russian oligarchs look little more then ordinary street thugs, in comparison. Yes, the Americans have beat our own thieves in the shear volumes. Should we congratulate them?
These men, of course, are not an elected panel but made up of appointees picked from the very financial oligarchs and their henchmen who are now gorging themselves on trillions of American dollars, in one bailout after another. They are also usurping the rights, duties and powers of the American congress (parliament). Again, congress has put up little more then a whimper to their masters.

Police were called Friday to the restaurant in Toledo.
Police say 24-year-old Melodi Dushane was treated for injuries, then jailed. She pleaded not guilty to a vandalism charge. She was released on a recognizance bond and ordered not to have contact with the restaurant. The phone number for her home address isn't listed.

AN ACT
relating to the creation of the offense of online harassment.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 33, Penal Code, is amended by adding
Section 33.07 to read as follows:
Sec. 33.07. ONLINE HARASSMENT. (a) A person commits an
offense if the person uses the name or persona of another person to
create a web page on or to post one or more messages on a commercial
social networking site :
(1) without obtaining the other person’s consent; and
(2) with the intent to harm, defraud, intimidate, or
threaten any person.
(b) A person commits an offense if the person sends an
electronic mail, instant message, text message, or similar
communication that references a name, domain address, phone number,
or other item of identifying information belonging to any person:
(1) without obtaining the other person’s consent;
(2) with the intent to cause a recipient of the
communication to reasonably believe that the other person
authorized or transmitted the communication; and
(3) with the intent to harm or defraud any person.
(c) An offense under Subsection (a) is a felony of the third
degree. An offense under Subsection (b) is a Class A misdemeanor,
except that the offense is a felony of the third degree if the actor
commits the offense with the intent to solicit a response by
emergency personnel.
(d) If conduct that constitutes an offense under this
section also constitutes an offense under any other law, the actor
may be prosecuted under this section, the other law, or both.
(e) It is a defense to prosecution under this section that
the actor is any of the following entities or that the actor’s
conduct consisted solely of action taken as an employee of any of
the following entities:
(1) a commercial social networking site ;
(2) an Internet service provider;
(3) an interactive computer service, as defined by 47
U.S.C. Section 230;
(4) a telecommunications provider, as defined by
Section 51.002, Utilities Code; or
(5) a video service provider or cable service
provider, as defined by Section 66.002, Utilities Code.
(f) In this section:
(1) ” Commercial social networking site ” means any
business, organization, or other similar entity operating a website
that permits persons to become registered users for the purpose of
establishing personal relationships with other users through
direct or real-time communication with other users or the creation
of web pages or profiles available to the public or to other users.
The term does not include an electronic mail program or a message
board program.
(2) “Identifying information” has the meaning
assigned by Section 32.51.

It doesn't. This is more of Philip Klein's retaliation crap. Kelly Pickard filed a complaint on him because he came into her house claiming he was an FBI agent. She has nothing to do with media.
Here is how stupid things can get on a public board – and now you know why I do not put up a public board. These are facts on file with the State of Texas and the Commission.
A woman, named Mrs. Pickard, was a target of an investigation being handled by our firm. She was interviewed at her residence with me and another investigator from our office. The entire conversation was recorded from the time the door opened until we left the front yard.
The State of Texas received a complaint regarding the interview two years after the interview. In that complaint it was stated that myself and the other investigator portrayed ourselves as “FBI Agents”. In such, the complainant just “wanted to report it” but refused to sign a sworn complaint. In accordance with state statute – the name of the complainant is withheld.
It was investigated and the tape was turned over to investigators. After reviewing the tape of the meeting – it was determined that the complainant was lying in their complaint. Since they did now swear out the complaint – they could not be prosecuted for filing a false police report.
It was at this time this story, rehashed now 20 times over, has been repeated without our comment. However, when the story is falsely posted on this board – or any – we will retort setting the record straight.
As for these other posts regarding a “Kelly Picard” – in Ms. Pickard’s defense the criminal record posted on this web site has nothing to do with her and we having nothing to do with posting it.
Again – many of you now understand why we do not have a post site and we killed the one we did have. Simply put, there are spineless people that attempt to hurt others that will say or post anything to try and hurt a business or a person based upon political beliefs. These short minded people are who they are. And they will not stop. But they will be named.
